These terms are an agreement between you and McKenna Holdings LLC, a Colorado limited liability company ("McKenna Holdings," "we," "us"), covering your use of the FishFly iPhone app and the fishfly.app website (together, "FishFly"). By downloading or using FishFly, you agree to them. If you don't agree, don't use FishFly.
FishFly gives you ranked fly pattern recommendations, rigs, and a day plan for a specific water on a specific day, saved offline as a trip pack. It is a reference and planning tool built on curated hatch data, public streamflow readings, and our own pattern library.
FishFly is not a navigation tool, a safety device, a weather service, or a source of legal or regulatory advice. See section 7.
You must be at least 13 years old to use FishFly. If you are under 18, you may use FishFly only with the involvement of a parent or guardian who agrees to these terms on your behalf.
FishFly includes one free trip pack, which gives you 48 hours of unlimited questions about a single water. After that, continued use requires a FishFly Unlimited subscription.
FishFly Unlimited costs $27.99 per year. It renews automatically every year at the same price unless you cancel. Payment is charged to your Apple Account at confirmation of purchase. Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within 24 hours of the end of the current period.
You manage and cancel your subscription in iOS Settings → your name → Subscriptions, not in the FishFly app. We cannot cancel or refund a subscription for you. Apple handles all billing. Deleting the app does not cancel your subscription.
Refunds are handled by Apple under Apple's Media Services Terms and Conditions. You can request one at reportaproblem.apple.com. If Apple declines and you believe you were charged in error, email support@mckenna.holdings and we'll do what we can to help, though the final decision is Apple's.
If we ever change the subscription price, we will tell you in advance and you will have the chance to cancel before the new price takes effect. Prices may vary by region and are subject to applicable taxes.
We grant you a personal, non-exclusive, non-transferable, revocable license to use FishFly on Apple devices you own or control, for your own non-commercial fishing.
You agree not to: use FishFly's content to build, train, or populate a competing product or database; scrape, bulk-download, or systematically extract our fly library, hatch calendars, or recommendations; resell, sublicense, or redistribute trip packs or app content commercially; reverse-engineer, decompile, or attempt to derive our source code, except where that restriction is prohibited by law; circumvent the free trip pack limit, the subscription check, or any other technical restriction; or use FishFly in any way that violates the law or interferes with our servers.
Sharing a trip pack with the friends you're fishing with is fine and expected. Republishing our content at scale is not.
The FishFly app, the fly library, pattern photographs, hatch calendars, recommendation logic, trip pack format, the FishFly name, and all related material are owned by McKenna Holdings LLC and protected by copyright and other intellectual property laws. Nothing in these terms transfers ownership to you.
Anything you send us (feedback, a bug report, a suggestion about a pattern or a water) you keep. But you give us permission to use it to operate and improve FishFly, including acting on suggestions, without any obligation to compensate you. Please don't send us anything you consider confidential.
We may add, change, or remove features; change which waters and regions are covered; or suspend FishFly for maintenance. We try to give notice for anything significant, but we don't guarantee uninterrupted availability. FishFly depends on services we don't control, including Apple, our hosting provider, and public USGS gauge feeds, and those can fail or change.
If we permanently discontinue FishFly, we will give you reasonable notice and stop charging renewals.
Our recommendations are informed guesses, not guarantees. Hatches vary, water conditions change hour to hour, and fish do what they want. We do not promise that any recommendation will catch fish, or that the conditions data we display is current or correct.
FishFly does not make the water safe. Rivers, wading, weather, cold water, and remote access are genuinely dangerous, and no app can assess the conditions in front of you. You are solely responsible for your own safety and for judging whether a place is safe to fish. Streamflow readings we show come from public USGS gauges, may be delayed or wrong, and must never be relied on as a safety signal. Do not use FishFly as a substitute for your own judgment, local knowledge, a check of current conditions, or telling someone where you're going.
You are responsible for following the law. Fishing licenses, seasons, closures, bag limits, gear restrictions, private property boundaries, and public access rules are your responsibility to know and obey. FishFly may show waters you are not permitted to fish, or fish you are not permitted to keep, and our information about regulations and access may be incomplete or out of date. Always check current regulations with the relevant state wildlife agency and confirm access before you go.
FishFly is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that FishFly will be error-free, uninterrupted, or that its content is accurate, complete, or current.
Some jurisdictions don't allow the exclusion of certain warranties, so some of the above may not apply to you.
To the fullest extent permitted by law, McKenna Holdings LLC and its members will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, property damage, or death, arising out of or relating to your use of FishFly, whether based in contract, tort, negligence, strict liability, or otherwise, and even if we've been advised of the possibility.
Our total liability to you for all claims relating to FishFly will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) fifty U.S. dollars ($50).
Some jurisdictions don't allow these limitations, so they may not fully apply to you. Nothing in these terms limits liability that cannot be limited by law.
You agree to indemnify and hold harmless McKenna Holdings LLC and its members from any claims, damages, losses, and reasonable legal fees arising out of your misuse of FishFly, your violation of these terms, or your violation of any law or third-party right.
You can stop using FishFly at any time by deleting the app and canceling your subscription through Apple. We may suspend or terminate your access if you materially breach these terms, with notice where practical. Sections 5, 7, 8, 9, 10, and 12 survive termination.
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute that can't be resolved informally will be brought exclusively in the state or federal courts located in Douglas County, Colorado, and you and we each consent to that jurisdiction.
Before filing anything, please email support@mckenna.holdings and give us 30 days to try to resolve it. Most things are fixable with a conversation.
These terms are between you and McKenna Holdings LLC, not Apple. Apple is not responsible for FishFly or its content, and has no obligation to provide maintenance or support. If FishFly fails to conform to any applicable warranty, you may notify Apple and Apple will refund your purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to FishFly, including product liability, regulatory compliance, or consumer protection claims, or for investigating or defending third-party intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government restricted-parties list.
These terms, together with our Privacy Policy, are the entire agreement between you and us about FishFly. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
We may update these terms. If we do, we'll change the date at the top and post the new version at fishfly.app/terms, and we'll notify you in the app before material changes take effect.
